Bayview Fitness, Fontygary — Terms & Conditions

1. Introduction

Welcome to Bayview Fitness, at Fontygary Parks Ltd (“we”, “us”, “our”). These Terms and Conditions set out the rights and obligations of anyone using our facilities, services, or memberships.
By joining the Bayview Fitness or entering our premises, you (“Member”, “you”) agree to comply with these Terms.
Our aim is to provide a safe, friendly, and professional fitness environment for all members and guests.

2. Membership Eligibility

- Members must be 14 years or older (gym only memberships) 16 and over for Gym and pool memberships. Under 18s will need to provide identification (passport, driving licence) prior to first use of the facility.
- We hold the right to ask individuals under 18 to obtain written consent from a parent or guardian.
- We hold the right to ask any individual to provide identification to prove their eligibilty to use the facilities.
- Memberships are personal, non-transferable, and non-refundable (except where required by law).
- Members must complete a PAR-Q (Physical Activity Readiness Questionnaire) before using facilities.
- You must inform us of any changes to your health or contact details.

3. Membership Types & Payments

- Membership options include monthly, annual, and pay-as-you-go plans.
- Monthly memberships are paid via direct debit and automatically renew each month unless cancelled.
- Annual memberships are paid in advance and expire automatically unless renewed.
- Payment must be received before access to the gym is granted.
- We may review and adjust prices periodically, providing at least 30 days’ notice.
- Failure to make payment may result in suspension of membership until the balance is cleared.

4. Cancellation and Freezes

- Monthly memberships may be cancelled by giving 30 days’ written notice via email to gym@fontygary.co.uk
- Annual memberships cannot normally be refunded, but may be frozen or transferred in exceptional cases (e.g., medical issues, relocation).
- Freezes are granted for a minimum of 1 month and a maximum of 3 months, subject to management approval.
- We reserve the right to cancel memberships immediately if rules are breached or abusive behaviour occurs.

5. Health, Safety & Liability

- Members are responsible for ensuring they are fit to exercise. Please consult a GP if unsure.
- All new members are encouraged to complete an induction session before using equipment.
- Members must use equipment correctly and follow all staff guidance.
- We are not responsible for injuries or health issues arising from misuse of equipment, improper exercise, or pre-existing conditions.
- Personal belongings are brought at your own risk. Lockers are provided, but Fontygary Parks Ltd accepts no liability for loss or theft.
- In the event of an emergency, please follow staff instructions and evacuation procedures.

6. Conduct and Behaviour

- Wear appropriate gym clothing and footwear.
- Tops must be worn at all times while in the facility.
- Wipe down equipment after use and re-rack weights.
- Be considerate - no shouting, offensive language, or misuse of equipment.
- Do not film or photograph others without permission.
- Drugs, alcohol, or smoking/vaping are strictly prohibited within the facility.
- Management reserves the right to remove or suspend any member behaving inappropriately.

7. Classes and Personal Training

- Classes operate on a first-come, first-served or pre-booking basis.
- Please cancel classes at least 24 hours in advance to avoid a late-cancellation charge.
- Personal Training sessions must be booked and paid for separately.
- Personal Trainers may be independent contractors; in such cases, the trainer is responsible for their own insurance and conduct.

8. Facilities

- Facilities may include a gym floor, fitness studio, pool, and changing rooms (as applicable).
- We may occasionally close areas for cleaning, repairs, or private events; notice will be provided where possible.
- Access is restricted to opening hours, which may vary seasonally.
- Members must leave the premises promptly at closing time.

9. Data Protection & Privacy

- Fontygary Parks Ltd complies with the UK GDPR and Data Protection Act 2018.
- We collect and store your personal information (e.g., contact details, health data) solely for membership management, safety, and communication purposes.
- Your data will never be sold or shared with third parties without consent.
- You have the right to access, correct, or request deletion of your data at any time by contacting reception@fontygary.co.uk.
- CCTV is used for security and safety in line with privacy regulations.

10. Liability & Indemnity

- You participate in all gym activities at your own risk.
- Fontygary Parks Ltd is not liable for injury, loss, or damage to property, except in cases of our proven negligence.
- By signing up, you agree to release Fontygary Parks Ltd, its staff, and contractors from liability for any claims arising from use of the facilities, except where the law requires otherwise.

11. Changes to Terms

-We may occasionally update these Terms to reflect new laws, policies, or services. Any changes will be posted on our website or displayed at reception, and will take effect 30 days after notice. Continued use of our services means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England and Wales.
